1. Acceptance of Terms
By accessing or using RealtorList.ca (the "Site") and its services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms apply to all visitors, users, and others who access or use the Site ("Users").
2. Description of Services
RealtorList.ca provides a platform that enables licensed real estate professionals ("Agents") to create and manage branded listing websites, and allows visitors to browse property listings and submit inquiries. The specific features available depend on the service tier selected.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.
3. Account Registration & Responsibilities
3.1 Agent Accounts
To use our paid services, you must:
- Be a licensed real estate professional in British Columbia, Canada
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Be responsible for all activity under your account
3.2 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.
4. Listings & Content
4.1 Agent Representations
As an Agent, you represent and warrant that:
- All listing information you provide is accurate and up to date
- You have the legal right to list and market the properties
- All photos and content you upload are your own or you have the right to use them
- Your listings comply with all applicable laws, including real estate advertising regulations
4.2 Content License
By submitting content to the Site, you grant RealtorList.ca a non-exclusive, royalty-free license to display, distribute, and promote your listings on the Site and through related marketing channels.
5. User Conduct
All Users agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable laws
- Submit false, misleading, or fraudulent inquiries
- Attempt to gain unauthorized access to any part of the Site
- Interfere with or disrupt the operation of the Site
- Scrape, crawl, or collect data from the Site without our express permission
- Harass, abuse, or harm other users or our staff
6. Pricing & Payments
Service fees are as listed on our pricing page and are subject to change with 30 days' notice. All fees are in Canadian dollars (CAD). Payments are processed securely through our payment partners. Refunds are handled on a case-by-case basis as outlined in our Refund Policy.
Failure to pay fees may result in suspension or termination of services.
7. Intellectual Property
The Site, its design, logo, brand name "RealtorList.ca", and all original content (excluding user-submitted listings) are the exclusive property of RealtorList.ca and are protected by Canadian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
8. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by RealtorList.ca. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites.
9. Limitation of Liability
To the maximum extent permitted by applicable law, RealtorList.ca and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site. This includes, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses.
We do not guarantee the accuracy, completeness, or timeliness of listing information. Listings are provided by third-party real estate agents and are for informational purposes only.
10. Disclaimer of Warranties
The Site and services are provided on an "as is" and "as available" basis. RealtorList.ca makes no warranties, expressed or implied, regarding the operation or availability of the Site, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Indemnification
You agree to indemnify, defend, and hold harmless RealtorList.ca, its operators, affiliates, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Site will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of British Columbia.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any modifications indicates your acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes.
